Contracts of Employment must be issued on or before the first day of employment

John Cook

Since 6th April 2020 all employees and workers are entitled to a ‘written statement of particulars of employment’ (usually contained in a Contract of Employment), which must be provided ‘not later than the beginning of the employment.’  Prior to April 2020 this written statement needed to be provided no later than two months after the employment start date.

A failure to provide a written statement or contract can have a negative impact on employee relations.  Although unlikely, there is also the risk of an Employment Tribunal claim.  An employee can be awarded up to four weeks’ pay (currently capped at a maximum of £700 per week) for a failure to provide the written statement.
